QUIETING OF A TITLE

"Quieting of Title" is an action by which an individual claiming to be the owner of land can have the title judicially investigated and declared; whether he or she has the legal estate or not, and whether his or her title is or is not subject to a charge or encumbrance.

Another person who claims the estate or interest in land may also apply for an investigation, ascertainment and declaration, but it shall be in the discretion of the judge before whom the proceedings are taken to grant or refuse the application.
